Before you sign a severance or separation agreement, it’s worth having an employment lawyer review it. We look at:
– The release language — what claims you’re giving up
– The consideration — is it commensurate with the claims?
– Non-disparagement, confidentiality, and non-cooperation clauses
– References, unemployment, and benefit-continuation terms
– Restrictive covenants (most non-competes are unenforceable in California, but they still appear)
– ADEA / OWBPA compliance (for employees 40+, 21-day review and 7-day revocation)
In many cases we are able to negotiate materially better terms.
